Terms of Service

These Terms of Service ("Terms") govern your use of The Game ("the app"), a word game available on the web and mobile devices, operated by The Game LLC, a Hawaii limited liability company ("we", "our"). By playing The Game, you agree to these Terms. If you do not agree, please do not use the app.

1. Who May Play

You must be at least 13 years old to use the app. If you are under the age of majority where you live, you may only use the app with the consent of a parent or guardian.

2. Your Account

An anonymous account is created automatically when you first open the app. You may optionally link it to a Google or Apple account to keep your progress across devices. You are responsible for activity that happens under your account. We may suspend or remove accounts that violate these Terms.

3. Fair Play

The Game is a competitive word game, and it only works if everyone plays fair. You agree not to:

Cheat, including using automated tools, bots, scripts, or word solvers to gain an advantage in ranked play
Manipulate scores, ratings, or match outcomes, including by colluding with other players or abusing multiple accounts
Interfere with other players' games, or access or modify game data outside the app's normal interface
Abuse, harass, or impersonate other players

We may reset stats, remove content, or suspend accounts involved in any of the above.

4. Player Content

Usernames and chat messages you submit are visible to other players. You are responsible for what you post. Do not submit content that is unlawful, hateful, harassing, sexually explicit, or that infringes anyone's rights. We may remove content or restrict accounts that violate this rule.

5. Our Content

The app — including its design, artwork, code, name, and word lists — is owned by us and protected by copyright and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the app for playing the game. You agree not to copy, scrape, decompile, reverse-engineer, or create derivative works from the app or its content, except where the law expressly permits it.

6. Availability & Changes

The Game is provided free of charge, and we work hard to keep it running smoothly — but we do not guarantee uninterrupted availability. We may add, change, or remove features (including game modes, rankings, and leaderboards) at any time, and may reset or adjust ratings when needed to keep competition fair.

7. Termination

You can stop using the app at any time, and may request deletion of your data as described in our Privacy Policy. We may suspend or terminate access to the app for violations of these Terms or to protect the game and its players.

8. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app will not exceed fifty US dollars ($50).

9. Governing Law

These Terms are governed by the laws of the State of Hawaii, United States, without regard to conflict-of-laws rules. Nothing in these Terms limits any rights you have under the mandatory consumer-protection laws of the place where you live.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the app after changes constitutes acceptance of the updated Terms.
